Visiting Scientist

UNIVERSITY OF MARYLAND, BALTIMORE VISITING SCIENTIST POLICY

I. GENERAL POLICY STATEMENT - INTRODUCTION

The Visiting Scientist Policy is established to facilitate the interaction of University of Maryland, Baltimore (UMB) faculty with other scientists, colleagues and students, who will have access to UMB research resources, facilities and faculty, not otherwise available to the public.

UMB faculty are encouraged to seek collaboration opportunities with colleagues and scientist affiliated with other academic institutions and/or from the for-profit sector.  UMB faculty are also encouraged to provide training opportunities to students who receive financial support from their Company and/or foreign governments. These students come to UMB and have direct access to UMB research facilities, resources and faculty.

In order to facilitate these interactions, while protecting the University's rights, it is important to strike a balance.

The Visiting Scientist Policy provides this balance.

A. On one hand the policy permits:

  1. Faculty to engage in on-campus, hands-on open research collaboration with professionals who are working in the academic, public, industrial and international communities;

  2. Faculty to have interchange of information; and

  3. Faculty to provide training and educational opportunities to students who may be employed and supported by the public, industrial and international communities.

B. On the other hand the policy protects:

  1. UMB's existing or potential intellectual property rights; and

  2. UMB's contractual obligation to sponsors.

II.PURPOSE

The purpose of the Policy for Visiting Scientist is to provide UMB faculty with guidelines to accomplish the following:

A. Provide a mechanism for hands-on instruction and/or research collaboration capability using UMB faculty, resources and laboratory facilities, to individuals who are not UMB employees;

B. Provide safeguards to ensure compliance with University System of Maryland (USM) policies and procedures, in particular USM intellectual property rights;

C. Provide safeguards to ensure compliance with UMB contractual obligations to federal and industrial sponsors;

D. Provide safeguards for UMB to retain original copies of laboratory notebooks;

E. Provide safeguards for UMB to require the visiting scientist to submit any reports or other outstanding documents prior to leaving UMB to the appropriate designated UMB individual.

III. APPLICATION

A. Anyone who will be working, training or observing in a UMB laboratory or other clinical facility and who is not subject to or covered under USM Employee or USM Student Policy.

  1. Employees working in the public, private industrial and/or international community who are representing and receiving financial support from their Institution or Company.

  2. Students and trainees who are not covered under USM Student Policy and registered as USM students who may be representing and receiving financial support from either an Institution or Company.

  3. Individuals who are external "collaborators" and or "consultants," who are not UMB employees.

B. The Visiting Scientist is someone who will have on-going, hands-on access to USM facilities and resources that are not otherwise available to the public.

IV.POLICY

UMB faculty members must, prior to arrival of the visitor on campus, require that a Visiting Scientist execute a Visiting Scientist Agreement.  If the Visiting Scientist will be representing a Company or an Institution or if his/her activities as a Visiting Scientist will be subject to employment or contractual requirements at the Company or Institution, the Visiting Scientist Agreement must be co-signed by the appropriate representative who is authorized to execute agreements and bind the outside Company or Institution.

V. PROCEDURES FOR OBTAINING A VISITING SCIENTIST AGREEMENT

Following this procedure will maximize UMB's ability to facilitate processing an appropriate Visiting Scientist Agreement and will curtail the adverse effects that result when a Visiting Scientist Agreement is not excuted.

A. Contact the Office of Research and Development and be prepared to answer the following questions:

  1. Will the Visiting Scientist be representing a Company or an Institution?

  2. Will the Visiting Scientist be receiving compensation or salary during their visit?  If so, from whom?

  3. What is the purpose of the visit?

  4. Will the Visiting Scientist have access to other faculty members, laboratories or other UMB facilities or resources not otherwise open to the public?  State specifically and in detail exactly where the Visiting Scientist will be working.

  5. Will the Visiting Scientist have access to existing or potential intellectual property?

  6. Will the Visiting Scientist be bringing any research material with him/her?

  7. If the answer to question number 6 is yes, will they be co-mingling the research material with any other material developed either by you or another faculty member at UMB?

  8. Will the purpose of the visit involve another sponsor?  If so, who?  Will the purpose involve local, state or federal funding?  If so, please identify the source of the funding.

B. The ORD will provide the faculty member with a Visiting Scientist Agreement which may be modified to adjust to differing circumstances based on the answers to the questions listed above.

C. The faculty member shall provide the Visiting Scientist with two copies of the Visiting Scientist Agreement for signature.

  1. If the Visiting Scientist is coming to UMB as an individual and is not subject to any contractual or employment constraints from an outside entity, both copies of the Visiting Scientist Agreement should be signed by the Visiting Scientist, as an individual and both signed copies returned to the UMB faculty member.


  2. Visiting Scientist who are coming to UMB and are subject to any contracual or employment constraints from an outside entity are required to sign both copies and have both copies signed by the appropriate representative of the Company or Institution who is vested with the authority to sign such agreements and return both signed copies to the University faculty member.

D. The faculty member must submit both copies of the signed agreement to the appropriate ORD Representative for signature.

E. The Visiting Scientist Agreement will be signed by the Executive Director of the ORD and a fully-executed copy will be returned to the faculty member. The faculty member will provide the Visiting Scientist with a copy of the fully-excuted Visiting Scientist Agreement.

F. VISITING SCIENTIST ARE PRECLUDED FROM COMMENCING THEIR PROGRAM AT UMB UNTIL A FULLY-EXECUTED VISITING SCIENTIST AGREEMENT IS OBTAINED.
